The result of the discussion was: delete. There's no actual basis for the assertion that this official portrait of the French president is PD, and it has been deleted repeatedly at Commons as copyvio.  Sandstein  07:12, 20 July 2017 (UTC)[reply]

According to Commons:Copyright rules by territory/France The rules for protection of works by the government are somewhat fuzzy, and one should assume by default that anything from a government entity is copyrighted., no reason is given why this "official item legally exempt from copyright in its country of origin". There is no evidence this is freely licensed and there are plenty of freely licensed images of Macron on the commons, such as all these 19 images, so a it would fail WP:NFCC#1. ww2censor (talk) 13:43, 1 July 2017 (UTC)[reply]
The website also says Toute autre utilisation doit faire l'objet d'une autorisation sollicitée directement auprès de la Présidence de la République à l'adresse photographes@elysee.fr., which means that if someone is willing to email photographes@elysee.fr then we might be able to get the image released under a suitable license. I am the uploader of the file, and I believe I made an error in judging the license. As I thought it was an official portrait released by the French government, I more or less 'assumed' it was published in the free domain. If we want to play by the rules, we sadly have to delete this file. Alternatively, we could pause its deletion for a couple more days, to see if guys on French Wikipedia can convince the copyright owner to publish the work in the free domain.   • The subject was discussed at the time of uploading, I believe that it was Masem held that a painting out of copyright cannot be copyrighted by merely adding a border and pricing the stamp. The same holds for others in the series. TheVirginiaHistorian (talk) 19:20, 30 June 2017 (UTC)[reply]

Keep as PD: Perhaps it is best to show that the stamp is freely licenced because it is merely an old painting with a small amount of non-copyrightable text added. The uploader, or someone else, can easily convert the details to reflect the facts and maybe should already have done so. ww2censor (talk) 15:32, 8 July 2017 (UTC)[reply]
