• The old name of the park is Santa Maria Municipal Park then they changed this to "Ricardo Nicolas Park" for honoring the late mayor Ricardo Nicolas Jr. for constructing the park. • Used in the infobox of Sweet and sour and licensed as "own work". Photo was likely taken by the uploader, but it's doubtful the uploader is also the copyright holder of the packaging of some of the products depicted in the photo. It's possible that the two plastic packets and tub of Long John Silver's sweet and sour sauce are too utilitarian for copyright protection, but it's not clear whether the same can be said about the bottle of La Choy and the bag of Sun Luck sauce. • It says that the photo was taken by some 'Jeremiah Parry-Hill' and the uploader's wording suggests that the uploader is someone else. Permission from the photographer is needed. Depending on the country of photography, the person who created this artwork may also need to give permission. The person who created the inappropriate watermark also needs to give permission. If the founder (me), ex-editor (me), and contact for the 501(c)(3) organization that represented GDT (me) says it's ok, what other possible permission is needed? 2.)     Yes, normally that would be enough, except that we don't actually know that User:Kjoenth and "Sean T. Hammond" are the same person. That's the sort of thing we have WP:OTRS for; an e-mail from an address known to belong to Sean T. Hammond can be used to authorize the relicensing of the logo. (N.B. that simply granting permission isn't enough; the logo would have to be relicensed under an irrevocable free Creative Commons license, allowing anyone to use it for any purpose in perpetuity.)

    But let's set aside the logo for now. The real problem is the photograph (a derivative work) of the copyrighted Unity sculpture.

• I clearly am not an expert regarding US copyright law--and let's ignore the article's implication that the sculpture is a derivative of GDT's logo--I think the use of the image falls under fair use because 1.) The photograph of the Unity sculpture was taken by someone that has authorized its use. 2.) The photograph is low resolution. 3.) the Unity sculpture is a) a permanent installation in b) a public c) outside space, and 4.) Use of the photograph with the gdt logo insert will be minimal in that it will 5.) be used to graphically illustrate the similarities between the GDT logo and the sculpture. I am fairly certain 4 and 5 also apply to the use of the GDT logo in the image. This requires altering the copyright and source info on the uploaded file, but it looks like it can be done with the upload wizard in a straighforward fashion.--Kjoenth (talk) 19:04, 18 November 2015 (UTC)[reply]

• Regardless, the Fair Use provisions of U.S. copyright law allow use of copyrighted materials on a limited basis for specific purposes without the permission of the copyright holder. This use appears to me to pass "The four factor test" as outlined here: http://libguides.mit.edu/usingimages

The Berne copyright convention resulted in the concept everything created privately and originally after April 1, 1989 is copyrighted and protected in the US whether it has a notice or not.
