- Der Model Penal Code (MPC) ist ein zwischen 1952 und 1962 vom American Law Institute ausgearbeitetes Musterstrafgesetzbuch für die Einzelstaaten der USA. Im Gegensatz zu Gesetzen, die von demokratisch legitimierten Verfassungsorganen erlassen werden, hat das von einem Expertengremium unter der Leitung des amerikanischen Juristen geschaffene Musterstrafgesetzbuch keine rechtsverbindliche Wirkung. - The Model Penal Code (MPC) is a model act designed to stimulate and assist U.S. state legislatures to update and standardize the penal law of the United States. The MPC was a project of the American Law Institute (ALI), and was published in 1962 after a ten-year drafting period. The chief reporter on the project was Herbert Wechsler, and contributors included Sanford Kadish and numerous other noted criminal law scholars, prosecutors, and defense lawyers. The ALI performed an examination of the penal system in the U.S. and the prohibitions, sanctions, excuses, and authority used throughout in order to arrive at a cohesive synthesis to the extent possible, and the best rules for the penal system in the United States. Primary responsibility for criminal law lies with the individual states, which over the years led to great inconsistency among the various state penal codes. The MPC was meant to be a comprehensive criminal code that would allow for similar laws to be passed in different jurisdictions. The MPC itself is not legally-binding law, but since its publication in 1962 more than half of all U.S. states have enacted criminal codes that borrow heavily from it. It has greatly influenced criminal courts even in states that have not directly drawn from it, and judges increasingly use the MPC as a source of the doctrines and principles underlying criminal liability. - 미국 모범 형법전(Model Penal Code)은 미국법률협회(ALI)에 의해 정리된 모범 형법전이다. 1962년에 처음 발간되었으면 가장 최근 판은 1981년에 작성되었다. 형법전을 발간한 목적은 미국내 형법을 통일하고 개선하는 것을 주로 하고 있다. 형법전은 ALI에 의해 가장 좋은 내용의 법규를 모아 엮었다. 1962년 발간으로 인해 각 주의 형법개혁이 촉진되었고 미국의 형법의 통일이 가속화되는 효과가 있었다. 연방정부가 만든 미국 연방 형법전에 비해 미국 모범 형법전이 큰 비공식적 영향력을 가지고 있다. 그러나 실제로는 법적효력을 가지지는 않는다.
