This classification has indeed been disputed since it was attributed to this movie. Indeed, its main required elements are absent: it has no femme fatale who drives any man to madness or crime; no rainy pavement and no blinds casting shadows upon protagonists. More importantly, there is no anti hero who thinks he is a good guy but doesn't know he isn't. Not even the detectives (played by Ronald Reagan) wears a fedora nor a trenchcoat (just a regular hat). It merely has fog in the first couple scenes and a crime is committed, but there is also no "gumshoe lingo". It is possible that the stark contrast in lighting and the desperation of characters is what caused the labeling as "noir", which many film buffs consider erroneous for this film.
